Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Rememberly application.

By downloading, installing, or using the App, you agree to be bound by these Terms.

Use of the App

Rememberly is a personal reading companion that allows you to save book highlights, quotes, and notes. The App is provided for your personal, non-commercial use.

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations.
  • Use the App to infringe upon the intellectual property rights of others.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Use the App to distribute malware or other harmful content.

User Content

You retain full ownership of any content you create within the App, including books, quotes, notes, and any other data you enter. All user content is stored locally on your device — we do not access, collect, or store your content on any server.

You are solely responsible for ensuring that the content you save does not violate any third-party rights, including copyright.

Camera and OCR

The App uses your device's camera to capture images of book pages and performs on-device text recognition (OCR) using Apple's Vision framework. All image processing occurs locally on your device. No images are uploaded or transmitted to external servers.

Third-Party Services

The App uses the Open Library API (openlibrary.org), a free public service operated by the Internet Archive, to search for book information and retrieve cover images. We are not responsible for the availability, accuracy, or content provided by Open Library. Your use of this feature is also subject to the Internet Archive's terms of service.

Intellectual Property

The App, including its design, code, graphics, and interface, is owned by Chandima Bandara and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or other proprietary content.

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The OCR text recognition feature relies on Apple's Vision framework and may not always produce accurate results. We are not responsible for any inaccuracies in recognized text.

Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or in connection with your use of the App.

Since all data is stored locally on your device, we are not responsible for any data loss resulting from device failure, accidental deletion, or any other cause beyond our control.

Termination

You may stop using the App at any time by uninstalling it from your device. All locally stored data will be removed upon uninstallation.

Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

Apple's Standard EULA

In addition to these Terms, your use of the App is subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.
