Please read these Terms and Conditions ("Terms") carefully before using the Rememberly application.

By downloading, installing, or using the App, you agree to be bound by these Terms.

Use of the App

Rememberly is a personal reading companion that allows you to save book highlights, quotes, page numbers, and notes. The App is provided for your personal, non-commercial use.

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App in any way that violates applicable laws or regulations.
Use the App to infringe upon the intellectual property rights or privacy rights of others.
Attempt to reverse-engineer, decompile, or disassemble the App, except where permitted by applicable law.
Use the App to distribute malware or other harmful content.
Interfere with or disrupt the App or any third-party service used by the App.

User Content

You retain full ownership of any content you create and save within your App library, including books, quotes, page numbers, notes, and other information you enter. App library content is stored locally on your device. We do not access, collect, or store your App library content on our servers.

You are solely responsible for the content you save, copy, export, or share using the App. You are responsible for ensuring that your use of quotes, book information, images, notes, and other content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights.

Camera, Photo Library, and OCR

The App uses your device's camera so you can capture images of book pages and perform on-device text recognition (OCR) using Apple's Vision framework. The App may also use your photo library so you can select an existing image for OCR and so the camera screen can show a small preview of your most recent photo as a shortcut to the photo picker.

Images used for OCR are processed locally on your device. We do not upload or transmit those images to our servers.

OCR may not always be accurate. You are responsible for reviewing and editing recognized text before saving or sharing it.

Book Search and Cover Images

The App uses the Open Library API (openlibrary.org), a free public service operated by the Internet Archive, to search for book information and retrieve cover images. Book metadata and cover images may be unavailable, incomplete, inaccurate, or changed by Open Library or its contributors.

We are not responsible for the availability, accuracy, legality, or content provided by Open Library. Your use of Open Library features is also subject to applicable Internet Archive and Open Library terms, policies, and usage guidelines.

Book cover images retrieved from Open Library may be cached locally on your device to improve performance.

Feedback and Support

The App may provide an optional feedback form through Google Forms. If you choose to submit feedback, you are responsible for the information you provide, and your use of the form may be subject to Google's terms and policies.

If you contact us by email, your communication may be handled by your email provider and our email provider. We may use feedback and support messages to respond to you, troubleshoot issues, and improve the App.

Copying and Sharing

The App may allow you to copy quote text to your device clipboard and generate shareable quote card images through the iOS share sheet. Sharing is controlled by you and by the destination apps or services you choose.

We are not responsible for how third-party apps, services, or recipients handle content after you copy, export, or share it from the App.

Third-Party Services

The App communicates with or opens the following third-party services:

Open Library, operated by the Internet Archive, for book search results and cover images.
Google Forms, if you choose to submit feedback.
Email services, if you choose to contact us by email.
Third-party apps or services selected by you through the iOS share sheet.

We are not responsible for the content, availability, terms, privacy practices, or actions of third-party services.

Intellectual Property

The App, including its design, code, graphics, interface, branding, and other proprietary materials, is owned by Chandima Bandara and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or other proprietary content, except for the limited right to use the App in accordance with these Terms and Apple's applicable license terms.

Third-party names, services, and content remain the property of their respective owners.

Privacy

Your use of the App is also subject to our Privacy Policy, available in the App and at:

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that OCR results, book search results, or cover images will be accurate or available.

Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, loss of content, loss of profits, or other damages arising out of or in connection with your use of the App.

Since App library content is stored locally on your device, we are not responsible for data loss resulting from device failure, operating system behavior, accidental deletion, uninstalling the App, or any other cause beyond our control.

Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded or limited under applicable law.

Termination

You may stop using the App at any time by uninstalling it from your device. Locally stored App data may be removed upon uninstallation, subject to your device and operating system behavior.

We may suspend, discontinue, or modify the App at any time, subject to applicable law.

Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles.

Apple's Standard EULA

In addition to these Terms, your use of the App is subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

If any provision of these Terms conflicts with Apple's applicable terms for App Store-distributed apps, Apple's applicable terms will control to the extent of the conflict.
